Im back at last and with a question about BL logo.

#1 Post by Welshspark »

Hi to all the familiar names on here.

It is ages since ive been back to this forum, since the debarcle with the possible hack on forum user information you will remember some time ago. But ive got round to re-registering now, albeit on this unofficial forum, but I hope not too much has changed.
Anyway, heres the question. Im thinking of setting up a second business and it will require the usage or recreating of certain classic car marques on my products, such as the BL logo and others, which im sure your all familiar with. To the best of my knowledge companies house has listed this name as being taken, but the trademark is no longer registered according to IPO.GOV.UK, possibly BMW own the brand but it has now been dormant for years. I know the PACCAR company uses leyland on the truck division they own, and another company ashok leyland has rights to the leyland brand.
Would it be illegal or breach any copyright laws if I use the images of such logos on my merchandise, and also images of car model name badge designs, that are no longer in use. Below are some examples. Many thanks in advance for any info on this.

i dont think bmw kept right to BL, only triumph and riley, the chinese have rights to mg rover, which is the former british leyland plc, so i think its chinese that have rights, but could be british motor heritage due to having right to austin etc

It was BMW who sued a couple of mini spares specialists back in 2002 over their use of the mini name and associated liveries & logos. The bunch of miserable badstarts.

They forced a Morris Minor spares company to change their name too. I can sort of understand it with mini but as Mogs went out of production 40 years ago you would have thought they wouldn't worry about that name!

 Yeah, that'll be them; the people who took the name of a perfectly formed little car and stuck it to the Cluntryman. The car that has the rear leg room of an E30 (none if the driver and front seat passenger are adults) with the bulk of an X3 (too much by any system of measurement) yet comes without the good features of either of those (OK, so the E30's a great car and the X3's, er, it's, well I'm led to believe that they have quite a good heater?......)

So the general opinion seems to be that if I use the old marqes and badge styles on my products then im likely to get sued for using them. Even though the company that possibly owns some distant rights to them is never likely to use them ever again anyway?
I mean I cant see why BMW would be bothered by me using the BL marque on my products (which would be aimed at the retro/classc car owners market) its not as if they are going to resurrect the brand it any time soon or ever for that matter. As for the model badge styles, can any company really claim ownership to those anymore, especially if they stopped using them 30 years ago etc and no modern model exists with the same name, would peugeot really care if I recreate the avenger badge font on my products? I can understand that it would be wrong to use the 'mini' name as that still exists and is in use, so I wouldnt be that stupid as to use that, but for things like the font styles of say Marina, Maxi, Viva, badges etc can anybody really own them.

as others have said I would be very careful of using anything that BMW have any rights to I am afraid. I have heard this from a number of sources.
